Declaration of consent for use of the Hargassner AI Support System

Preamble

Hargassner, an Austrian company from the Innviertel with a long tradition and a pioneer in the field of biomass heating systems, developed this AI Support System to offer you even better service. Please read this declaration of consent carefully before using the Hargassner AI Support System, which is embedded in the Hargassner app and in the Hargassner website. By using the AI Support System, you consent to the processing of your personal data in accordance with this declaration.


Section 1 Responsible office

Section 2 Purpose of data processing

The Hargassner AI Support System processes your personal data for the following purposes:

  1. Answering your questions and providing information on Hargassner products and services.
  2. Support for troubleshooting in the context of your Hargassner heating system.
  3. Providing personalised recommendations and help services based on your requests and any existing information on your heating system.
  4. Improving the functionality and accuracy of the AI Support System by analysing user interactions.

Section 3 Categories of personal data processed

In the course of using the Hargassner AI Support System, the following categories of personal data may be processed:

  1. The questions and requests which you enter.
  2. Information relating to your Hargassner heating system (e.g., model, configuration, settings, error codes), assuming that you provide this information in the scope of your request, or it is automatically transferred via the app or website.
  3. AI Support System usage data (e.g., the date and time of use, the duration of the interaction, the functions used).
  4. Possibly, depending on integration, your user account data for the Hargassner app or website (e.g., name, contact data).

 


Section 4 Data recipients or categories of data recipients

Your personal data may be forwarded to the following data recipients or categories of data recipients:

  1. Internal employees of Hargassner Ges. m.b.H., who are responsible for provisioning and maintaining the AI Support System (e.g., Customer Service, Development).
  2. External service providers commissioned by Hargassner in the scope of provisioning the AI Support System (e.g., the vendor of the AI technology, IT service providers).

 


Section 5 Data retention period

Your personal data will only be stored for as long as necessary in order to achieve the aforementioned purposes, or as envisaged by legal retention periods. Interactions with the AI Support System are typically stored for an appropriate period in order to allow subsequent queries to be answered and to improve the system performance.


Section 6 Your rights as a data subject

You have the following rights under the General Data Protection Regulation (GDPR):

  1. Right to information (Art. 15 GDPR): You have the right to request information about whether and which of your personal data is being processed.
  2. Right to rectification (Art. 16 GDPR): You have the right to request the correction of incorrect or incomplete personal data.
  3. Right to deletion (Art. 17 GDPR): You have the right to request the deletion of your personal data under certain conditions.
  4. Right to restriction of processing (Art. 18 GDPR): You have the right to request the restriction of the processing of your personal data under certain conditions.
  5. Right to data portability (Art. 20 GDPR): You have the right to receive your personal data, which you provided to us, in a structured, commonly used and machine-readable format and to transmit this data to another responsible entity.
  6. Right to object (Art. 21 GDPR): You have the right to object to the processing of your personal data if the processing is based on legitimate interests.
  7. Rights in relation to automated decision-making (Art. 22 GDPR): You have the right not to be subject to decision-making based solely on automated processing, including profiling, which generates a legal impact on you or affects you in a similarly significant manner.
  8. Right to revoke consent (Art. 7, para. 3, GDPR): You have the right to revoke your consent to the processing of your personal data at any time. The revocation of consent shall not affect the lawfulness of processing based on consent prior to revocation.

 


Section 7 Revoking consent

You can revoke your consent to the processing of your personal data by Hargassner AI Support at any time with effect on the future. The revocation can be made informally, for example by email to [email protected] or by using a corresponding function in the app or on the website if such a function exists. After you revoke your consent, we will no longer process your personal data for the purposes to which you previously consented, unless there is another legal basis for the processing.

 


Section 8 Right to lodge a complaint with a supervisory authority

If you consider that the processing of your personal data infringes the GDPR, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or the place of the alleged infringement.

For Germany, the appropriate supervisory authority is the State Commissioner for Data Protection and Freedom of Information of the respective federal state. For Austria, the appropriate supervisory authority is the Austrian Data Protection Authority (Österreichische Datenschutzbehörde), Barichgasse 40-42, 1030 Vienna, Austria.

 


Section 9 Consent

By using the Hargassner AI Support System, I confirm that I have read and understood this declaration of consent and agree to the processing of my personal data as described above.
